1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to place an order. If you are under 18, you may use the Website only with the involvement of a parent or guardian.

2. Your Account

You may place orders as a guest or by creating an account. If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Please inform us immediately of any unauthorised use.

3. Products and Descriptions

• We make every effort to display our jewellery accurately, including materials, dimensions and finishes.
• Because pieces are finished by hand, slight variations in colour, finish, size or stone placement may occur. Such variations are not defects.
• Colours may appear slightly different depending on your screen settings.
• All products are subject to availability.

4. Pricing

• All prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise.
• Shipping charges, if any, are shown separately at checkout. See our Shipping Policy.
• We may change prices at any time without notice. The price payable is the price shown at the time you place your order.
• If a product is listed at an incorrect price because of a technical or typographical error, we may cancel the order and refund the full amount paid.

5. Orders and Payment

• All orders are prepaid. Payments are processed securely by our payment partner, PhonePe, using UPI, cards, net banking or other methods offered at checkout.
• We do not store your card, UPI PIN or bank credentials on our servers.
• An order is confirmed only after payment is successfully received. You will receive an order confirmation by email.
• We may refuse or cancel an order if the product is unavailable, the delivery address cannot be serviced, the payment is suspected to be fraudulent, or there is a pricing error. In such cases, any amount paid is refunded in full as described in our Refund Policy.

6. Shipping, Returns and Refunds

Shipping, returns, replacements and refunds are governed by the following policies, which form part of these Terms:

• Return & Replacement Policy: damaged, defective or incorrect items are replaced free of charge.
• Refund Policy: we do not offer refunds on delivered orders, except in the specific cases listed in that policy.

7. Intellectual Property

All content on the Website, including the MISNOIR name, logo, product designs, photographs, text and graphics, belongs to MISNOIR or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute or use this content for commercial purposes without our prior written permission.

8. Acceptable Use

You agree not to use the Website for any unlawful purpose, to place fraudulent orders, to interfere with the Website's security or operation, or to submit false or misleading information.

9. Limitation of Liability

To the extent permitted by law, MISNOIR's total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, or for delays or failures caused by events outside our reasonable control, including courier delays, natural events, strikes or government restrictions.

10. Privacy

Your use of the Website is also governed by our Privacy Policy, which explains how we collect and use your personal information.

11. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Orders are governed by the Terms in effect at the time the order was placed.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or your use of the Website is subject to the exclusive jurisdiction of the courts at the place of MISNOIR's registered business address.

13. Grievance Redressal

If you have a complaint or concern, please contact us using the details below. We will acknowledge your complaint within 48 hours and aim to resolve it within 30 days, in line with the Consumer Protection (E-Commerce) Rules, 2020.
